EQUIPMENT, RENT & TERMS OF RENTAL AGREEMENT:

1. The undersigned as Lessee, hires from Tony Nader Trading as JumpSafe Castles as Lessor, one jumping castle.

DELIVERY:

2. To the street address specified by Lessee (Customer) as the 'Delivery Address'. 3. The Lessee grants the lessor the right to enter the property at the delivery address for the delivery and subsequent pick up of the jumping castle at the specified time.

TRANSPORTATION EXPENSE:

4. Except as provided herein, all charges in delivering and subsequent pick up of the JumpSafe Castle with respect to the Delivery Address are included in the Rental Fee noted above. 5. In the event that Lessee does not return the jumping castle at the appointed time to the Lessor a minimum $50 Transportation Fee shall be automatically due and payable by the Lessee to JumpSafe Castles.

SAFE OPERATION ACKNOWLEDEMENT :

6. The Lessee acknowledges that he/she has been instructed about and fully understands the safe operation of the JumpSafe Castles’ jumping castle that is subject of this Agreement.                                                                                                                          7. The Lessee agrees to observe all safety precautions. JumpSafe will ask you to confirm that you are satisfied with the set up of the castle.  8. The Lessee also represents and warrants the safe return of the unit and hereby agrees to pay the full purchase price, at current ordinary market rates, on hired items, if it is not returned on demand. 9. The Lessee agrees to keep the JumpSafe Castles’ jumping castle in the same condition as when received. The Lessee will be responsible for the cost of damage incurred during the term of the hire.                                                                                                                         10. If upon pick up, cleaning of the jumping castle is required a minimum $50 cleaning fee shall be automatically due and payable by the Lessor.

ALTERATIONS AND ATTACHMENTS :

11. No alteration in or attachments to the JumpSafe Castles’ jumping castle will be made without prior written approval of the Lessor.

WARRANTY:

12. Lessor warrants that the JumpSafe Castles’ jumping castle leased under this Rental Agreement will be in good working order on the effective date of the Rental Agreement. 13. The JumpSafe Castles’ jumping castle is supplied and maintained subject to this warranty.                                                                                                                             14.Lessor&^%&s obligation under this Rental Agreement is limited to cleaning, repair or replacement of the JumpSafe Castles’ jumping castle                                           15a. This warranty is in lieu of any and all other warranties expressed or implied.

TITLE TO:

16. The Lessee agrees to keep the JumpSafe Castles’ jumping castle in his/her custody. 17. The Lessee agrees not to sublease, rent, sell, or remove from the Delivery Address, or otherwise transfer possession or control of the JumpSafe Castles’ jumping castle.           18. The JumpSafe Castles’ jumping castle will remain the property of the Lessor and may be removed by the Lessor at any time after the termination of this Rental Agreement.

RELEASE OF LIABILITY:

19. The lessee shall be in charge of the JumpSafe Castles’ jumping castle, and is fully responsible for it&^%&s operation, fitness for purpose and condition on use.                                      20. The lessee is responsible to ensure JumpSafe Castles’ jumping castle is in and remains in good working order at all relevant times.                                                                              21. The Lessor and its officers, employees and agents is/are not responsible for injury occurring to the Lessee or any other persons using the JumpSafe Castles’ jumping castle.                                     22. The Lessee further agrees to hold the Lessor and its officers, employees and agents free and harmless against any injury or claims involving the use and return of the JumpSafe Castles’ jumping castle.                                                                              23. Lessee shall indemnify the Lessor and it&^%&s officers, employees, and agents from/against any costs incurred due to claims from anyone and for legal fees and related costs involving the use and return of the JumpSafe Castles’ jumping castle, should legal action become necessary.

ENTIRE AGREEMENT:

24. The Rental Agreement, taken in context with the Rules and Safety Instructions and the Special Instructions above and the acknowledgement below, constitutes the full agreement between Lessor and Lessee.                                                                                      25. Time is of the essence in this Rental Agreement.

RAIN POLICY :

26. During periods of severe weather conditions (including amongst others heavy rain, high winds, electrical storms), the Lessor reserves the right at the discretion of the Lessor to cancel the agreement and reservations to ensure the safety of all involved. 27.If conditions are, in the opinion of the Lessor, “not too severe” you may be given the option of completing this Agreement or cancelling the agreement and reservation. 28. If the lessee decides to complete this agreement in such conditions the lessee bears all responsibility arising from that decision.
